Terms of Service
These Terms of Service ("Terms") are an agreement between you and AutoBodyHQ ("AutoBodyHQ.com," "we," "us," or "our"). By using AutoBodyHQ or sending us an estimate, you agree to these Terms. If you do not agree, please do not use the service.
The service
AutoBodyHQ provides a free, informational estimate audit. You send us an insurance estimate, and we return a Missed Money Report that lists operations the estimate may be missing and an estimate of the dollars involved, priced using the rates shown in your estimate. The service is provided at no charge.
The report is informational, not a guarantee
The Missed Money Report is advisory and informational only. It is our analysis and opinion to help you review your own estimate. It is not a guarantee that an insurer or any other party will pay any amount, and it is not legal advice. You are responsible for verifying every item against the repair plan, the applicable procedures, and your own judgment before you act on it. We are not your lawyer and using the service does not create an attorney-client relationship.
Your responsibilities
- Right to share the estimate. You represent and warrant that you have the right to share each estimate you upload and that doing so does not break any law, contract, or duty you owe to anyone else.
- You are responsible for how you use the report, including any supplement or claim you submit based on it.
- You will not misuse the service or try to interfere with how it works.
License you grant us
When you upload an estimate or other data, you grant us a worldwide, royalty-free license to use, store, copy, and process that data to provide the service to you and to improve and train our analysis and service. This license supports our retention and training practices described in our Privacy Policy, including keeping estimates and reports so we can make our analysis more accurate over time.
Intellectual property
We own AutoBodyHQ and the technology behind it, including our analysis methods, software, and the format of the Missed Money Report. You keep ownership of your own data, including the estimates and shop information you provide. Nothing in these Terms transfers ownership of your data to us or of our technology to you.
Privacy
Our Privacy Policy explains what we collect, how we use it, the AI and hosting providers we rely on, and your choices. By using the service, you agree to that policy.
"As is" and disclaimer of warranties
The service and the report are provided "as is" and "as available," without warranties of any kind, whether express or implied. To the fullest extent allowed by law, we disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the report will be complete, error-free, or that it will lead to any particular outcome or payment.
Limitation of liability
To the fullest extent allowed by law, AutoBodyHQ and its owners, employees, and providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, lost revenue, or lost data, arising out of or related to your use of the service or the report. Because the service is provided free of charge, our total liability for any claim related to the service will not exceed one hundred U.S. dollars ($100).
Changes to the service and these Terms
We may change, suspend, or stop the service at any time. We may also update these Terms from time to time. When we do, we will change the effective date at the top of this page. If you keep using the service after a change, you accept the updated Terms.
Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute relating to these Terms or the service will be handled in the state or federal courts located in Los Angeles County, California, and you agree to that jurisdiction.
